Brazeno.com LLC (“Brazeno”) provides, without limitation:

  • Communication APIs: SMS, Email, and Voice messaging services
  • AI Chatbot Platform: Automated customer support and engagement solutions
  • Self-Service Portal: Campaign management and messaging tools
  • Software Development: Custom application development and consulting
  • Utility Services: Outage reporting, bill payment, and balance checking

3. User Accounts and Registration

3.1 Account Creation

To use our services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use
  • Be at least 18 years old or have parental consent

3.2 Account Responsibilities

You are responsible for:

6. Payment Terms

You agree to pay fees as set forth in your service plan. All fees are non-refundable unless otherwise required by law. You are responsible for applicable taxes. Failure to pay may result in suspension or termination of services.

7. Intellectual Property

Brazeno retains all rights to its platform, software, documentation, trademarks, and proprietary methods. You retain ownership of your content, data, and applications. You grant Brazeno a limited license to process your content solely for providing the services.

8. Data Protection

Our processing of personal data is governed by our Privacy Policy. By using our services, you consent to such processing.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Brazeno.com LLC, its owners, officers, employees, and agents shall not be personally liable for any damages.
  • Brazeno’s total aggregate liability for any claim shall not exceed the greater of (i) fees paid by you to Brazeno in the three (3) months preceding the claim or (ii) USD $100.
  • Brazeno shall not be liable for indirect, incidental, consequential, punitive, or special damages, including lost profits, lost data, or loss of goodwill.
  • All warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, are disclaimed.

10. Indemnification

You agree to indemnify, defend, and hold harmless Brazeno.com LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of third-party rights or applicable laws
  • Content or communications sent through your account

11. Termination

We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees, or if required by law. You may close your account by written notice, provided all outstanding fees are paid.

12. Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws. Disputes shall first be attempted in good faith negotiation, then mediation, and if unresolved, final and binding arbitration in Delaware.

13. Force Majeure

Brazeno is not responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, acts of government, labor disputes, internet outages, or third-party failures.

14. Changes to Terms

We may update these Terms by posting revised Terms on our website. Continued use of services after changes constitutes acceptance.

15. Severability

If any provision of these Terms is held unenforceable, the remainder shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any written service agreements, constitute the entire agreement between you and Brazeno regarding the services.
